Artisan Partners Asset Management was included in the SEC's industry-wide enforcement sweep targeting off-channel communications violations. The SEC's Press Release 2024-46 (February 2024) charged multiple firms for widespread and longstanding failures to maintain and preserve electronic communications required under federal securities recordkeeping laws. Personnel at these firms, including supervisory staff responsible for compliance, routinely used unapproved messaging platforms such as WhatsApp and personal text messages for business-related communications. These records are legally required to be preserved for insider trading and market manipulation surveillance. The SEC's off-channel enforcement initiative, spanning 2021-2025, has resulted in over $2 billion in combined penalties across approximately 70 firms, reflecting a systemic industry failure to maintain compliance infrastructure.
