Property & Ownership

Freehold ownership: Yes Mechanism: 1) Obtain Portuguese tax number (NIF); 2) Open a Portuguese bank account; 3) Sign promissory contract (CPCV) with deposit; 4) Execute final deed (escritura) before a notary; 5) Register at the Land Registry and pay IMT and stamp duty. Restricted zones: No general geographic restrictions for foreign buyers; standard planning, coastal protection and heritage rules apply equally. Recent changes: Law 56/2023 ended Golden Visa real‑estate routes, tightened short‑term rental rules, and introduced new investment options for Golden Visa.

Visa & Residency Options

Residence visa for holders of own income (D7)

  • Min income: ~€870–920/month main applicant (indexed to Portugal’s national minimum wage; plus 50% per spouse, 30% per dependent child — confirm exact figure with consulate before applying)
  • PR path: Eligible after 5 years of legal residency (subject to language and other requirements)
  • Income thresholds tied to minimum wage; confirm exact figure with consulate. Health insurance and accommodation required.

Residence/temporary stay visa for remote work (D8)

  • Min income: Approximately $3,800 per month (4× Portuguese minimum wage)/month USD
  • PR path: Standard 5‑year residency leads to permanent residency or citizenship
  • Keep employer/contractor letters and proof of remote work; income must be maintained throughout stay.

Residence visa for independent professional activity or migrant entrepreneurs (D2)

  • Investment: No fixed statutory minimum; must demonstrate investment operations and sufficient financial means
  • PR path: Standard 5‑year legal residency for permanent residency/citizenship
  • StartUP Visa requires an incubator contract/acceptance from IAPMEI.

Autorização de Residência para Atividade de Investimento (Golden Visa – ARI)

  • Investment: Fund/VC: €500,000 (~$545,000); Scientific research: €500,000; Cultural heritage: €250,000; Business/job creation: €500,000 plus 5‑10 jobs
  • PR path: After 5 years of maintaining residency (average 7 days/year stay) you may apply for permanent residency or citizenship
  • Law 56/2023 eliminated real‑estate routes; current routes focus on funds, research, culture and job creation.

Social Security & Tax

⚠️ NHR tax regime ended March 31, 2025 — this changes the retirement math significantly.

The Non-Habitual Residency (NHR) tax regime — which gave new residents a flat 20% rate on Portuguese-source income and a 10% flat rate on foreign pension income for 10 years — is closed to new applicants. It ended March 31, 2025.

The replacement regime, IFICI (formerly called “NHR 2.0”), took effect January 1, 2024. IFICI does not apply to retirees drawing pensions or Social Security. It is limited to researchers, qualified professionals in designated sectors, and workers relocating for specific jobs. American retirees arriving after March 2025 do not qualify.

What this means for American retirees:

  • Pension income (401k, IRA withdrawals, Social Security): Taxed under Portugal’s standard progressive income tax rates, which rise to 48% on income above ~€81,000 and apply partially from ~€7,700 onward.
  • The US–Portugal totalization agreement (above) eliminates double Social Security taxation but does not eliminate Portuguese income tax on pension distributions.
  • Investment income: Subject to Portuguese tax (28% flat rate for capital gains/dividends, or progressive rate if lower).
  • Consult a Portuguese tax attorney before relocating — the effective rate on a typical American retiree’s income is now materially higher than expat blogs written before 2025 suggest.
