Property & Ownership

Freehold ownership: No (for land) Mechanism: Foreigners cannot own land in Thailand. Two legal options exist: (1) Condominium freehold — foreigners may own a condo unit outright in a building where total foreign ownership does not exceed 49% of floor area (Condominium Act B.E. 2522, as amended). (2) Leasehold — 30-year lease agreements, renewable by contract (not automatically by statute). Longer-term structures using Thai-national nominees are legally risky and actively discouraged. Restricted zones: All land. Foreign nationals may not hold chanote (title deed) to land under their own name. Board of Investment (BOI) incentives and LTR visa holders do not change the underlying ownership restriction. Recent changes: No change to the fundamental restriction. Discussions emerged in 2023–2024 about potentially expanding foreign land ownership rights (leasehold extension to 99 years or pilot freehold zones), but no legislation has been enacted as of early 2026. Treat any agent claims about “new ownership rights” as unverified until a law change is confirmed.
